Terms of Sale

PAYMENT

No item will be shipped, or production started on custom items until payment is received in full. Payment can be made by Visa, Master Card, Discover, Diners, Cashier’s Check, Money Order, or Personal Check. Orders paid by Personal Check will not ship until check clears.

SALES TAX

Orders Shipped To South Carolina will have a 6% sales tax added unless a valid South Carolina Tax Exemption Certificate is faxed or mailed to Atlantic Pool Supply.

SHIPPING

Method of shipping is at our discretion. We ship by UPS whenever possible. On larger items we ship by the LTL Common Carrier that best serves your area. We shall not be liable for loss or damage of any kind resulting from delay or inability to deliver on account of labor troubles, fire, acts of civil or military authorities, accident, or from any cause beyond our control. You are responsible for checking your shipment upon arrival, and any damages or shortages, should be noted and filed with the carrier.

PRICES

Prices are subject to change without notice. Written quotations automatically expire 30 days from the date issued and may be terminated by notice within that period.

CANCELLATION

Orders on custom items cannot be cancelled after production has started. An order cannot be cancelled after it has been shipped.

WARRANTIES

There are no Express warranties and no implied warranties other than manufacturer’s warranties provided with the products. There are no other warranties made by Atlantic Pool Supply.

PRODUCT LIABILITY

We shall be held harmless for faulty installation of any products offered for sale, and will specifically not be held responsible for damage to pools or consequential damage to other property or persons resulting from improper installation and/or incorrect size of diving boards, slides, motors, heaters, and other deck equipment. Shipment and/or payment of merchandise constitutes acceptance of these terms and conditions by the buyer.

RETURNS

No returns will be accepted without prior authorization from Atlantic Pool Supply. Returns shall be freight pre-paid. Shipping charges are non refundable and a restocking fee may also apply. ALL RETURNS ARE SUBJECT TO A 20% RESTOCKING FEE. NO RETURNS ON SPECIAL ORDERS.

CUSTOM OR SIZED ITEMS

All orders for custom made or sized items, such as pool liners, covers, etc. shall be submitted in writing by fax, e-mail, or mail. Items made to your written specifications are not returnable if they do not fit properly. Contact us if you have questions about measuring

FINAL TERMS

Your placing an order with us shall constitute your assent to the conditions and terms herein, and shall constitute your agreement that such terms and conditions are the sole terms and conditions of the contract with us.
